On May 1, 2024, the 6-week abortion ban went into effect in Florida.
In April of 2023, Governor DeSantis signed a 6-week abortion ban into law making it illegal to have an abortion in the state of Florida after six weeks of pregnancy. However, because of the status of the 15-week ban being challenged in the courts, the 6-week ban could not go into effect when it was passed. Then, on April 1, 2024, the 15-week ban was upheld by the FL Supreme Court, automatically triggering the implementation of the 6-week ban, 30 days later on May 1st, stopping abortions in Florida after 6 weeks of gestation. The 6-week law does provide exceptions for cases of rape, incest, and human sex trafficking; it also maintains current exceptions allowing abortion to save the life and health of the mother and for fatal fetal anomalies.
With the 6-week ban in place in Florida, surgical abortion is legal up to the 6th week of pregnancy, except for in cases of rape, incest, and human sex trafficking, necessary to save a mother’s life, prevent serious injury to the mother, or if the baby has a fatal abnormality.3 In these cases, women may have a surgical abortion up until the 15th week of pregnancy (111 days after your last period).4
Under the 6-week ban, the abortion pill can legally be prescribed for women who are pregnant for up to 6-weeks with a doctor’s prescription.5 The same requirements for counseling, ultrasound, and 24-hour wait period apply to all medical abortions (abortion pill), whether the prescription is made online or in person. or in person.
Yes, in certain cases there are exceptions for abortions past 6 weeks in Florida. These exceptions include if an abortion is necessary to save the mother’s life, prevent serious injury to the mother, or if the baby has a fatal abnormality.6
Yes, Florida law requires parental consent for a minor to receive an abortion. Women under 18 notify at least one parent or guardian 48 hours before an abortion and obtain consent from a parent OR get approval from a judge through a process known as judicial bypass.7

Yes, PlanB (also called the morning after pill) is available over the counter in most drug stores. Plan B is not the same as the abortion pill and will not end an existing pregnancy. It is a form of emergency contraception that can prevent pregnancy if taken within 5 days of having sex.
